People of Colour Illustrations: Klip Klik Art and future software is furnished under a license agreement and may be used only in accordance with the terms of the agreement.
IMPORTANT. Carefully read the license agreement before opening your disk package. By opening the sealed box, you indicate your acceptance of the Williams Floyd and Moore/SV Publications License Agreement. NOTICE TO USER. This is a legal agreement between you, the end user, and Williams Floyd and Moore/SV Publications (SVP). The enclosed SVP software program is licensed by SVP for use only on the terms set forth herein. GRANT OF LICENSE. SVP grants to you the right to use one copy of the enclosed SOFTWARE on a single terminal connected to a single computer (i.e., single CPU) or to a network server. If you install the SOFTWARE on a network server, you must purchase a separate copy of the SOFTWARE for each computer terminal that will be used to operate the SOFTWARE. Please contact SVP about upgrading to a volume license agreement or website use license agreement. COPYRIGHT. The software is owned by SVP or its suppliers and is protected by United States copyright laws and international treaty provisions. You may either (a) make one copy of the software solely for backup or archival purposes provided that you reproduce all copyright and other proprietary notices that are on the original copy of the software provide to you, or (b) transfer the software to a single hard disk provided you keep the original solely for backup or archival purposes. SCOPE OF USE. As a legitimate purchaser of the software, you may use the images contained in this product as electronic clip art for your own customary business or personal purposes, providing that the art may not be used as part of any clip art collection (print or electronic form) or in any way resold as graphics designed for use by third parties, with the exception of images used as an incidental part of graphics design work done for hire. You may use the contents as decorative, typographic, or illustrative material that is included as part of a total graphic design for print or other communication channel produced for you, your client, your employer, that is not for resale or redistribution as art for reproduction or as any form of stock design. SVP LICENSE AGREEMENT. SVP does give you permission to incorporate and distribute, duplicate or modified images as an incidental part of any non-electronic product or collection of products which are distributed commercially (i.e., package, newsletter, brochure, etc.) provided the use or distribution of any of the images does not constitute a substantial portion of the value of the goods distributed commercially. The clip art may not be used as the primary component of products manufactured for resale for commercial profit such as t-shirts, note pads or other items featuring the art as the main selling point (contact SVP for clarification). Further, the art may not be used for any purposes relating to hatred, bigotry or illegal acts. You may not use any of the contents, in whole or in part, for multiple resale in the form of stock proofs, engravings, film mats, printing, digitized images, etc., without written permission. The clip art may not be used on internet world wide web pages or in any other medium that allows electronic access to the images or computer files by third parties, unless the user first completes a separate licensing agreement, which requires the payment of additional licensing fees, and fulfillment of certain other requirements and restrictions. The software and booklets are copyright ©1996 by Williams Floyd and Moore. Neither the software nor any part of the booklet may be duplicated or reproduced in any form whatsoever, except as noted, without the prior expressed written consent of SVP. Neither the disc nor the book or reproductions thereof, in whole or in part, may be used or possessed by any other person or entity who is not a bona fide purchaser of the product. Violators will be prosecuted. ANTI-PIRACY POLICY. SVP vigorously protects its copyrights, trademarks, patents and other intellectual property rights. In the United and many other countries, copyright law provides for severe civil and criminal penalties for the unauthorized reproduction or distribution of copyrighted material. Copyright material includes, but is not limited to computer programs and accompanying sounds, images and text. Under U.S. law, infringement may result in civil damages of up to $100,000 and/or criminal penalties of up to five years imprisonment and/or a $250,000 fine. OTHER RESTRICTIONS. You may not rent or lease the software. You may not reverse engineer, decompile, disassemble or create derivative works from the software. SVP retains title and ownership of the software, the media on which it is recorded, and all subsequent copies of the software, regardless of the form or media in or on which the original and other copies may exist. Except as noted, the agreement, does not grant you any intellectual property rights in or to the software. TERM. The license is effective until terminated. SVP has the right to terminate your license immediately if you fail to comply with any term of this Agreement. Upon any such termination, you will destroy the original and any copies of the software and related documentation. LIMITED WARRANTY AND LIABILITY. SVP warrants the media/disc(s) on which the software is provided to be free from defects in materials and workmanship for a period of 30 days from the date of purchase. Upon receipt of the original defective disc(s) returned by the registered owner, SVP will repair or replace the discs in a timely manner and return it to the customer via first class mail. SVP provides no other warranties, expressed or implied, and assumes no other liabilities of any kind relative to the sale or use of this product. This warranty gives you specific legal rights, and you may have other rights that vary from state to state. No SVP employee, dealer or agent is authorized to make any modification, extension or addition to this warranty. DISCLAIMER OF DAMAGES. In no event will SVP or its suppliers be liable for direct, indirect, special, consequential or incidental damages resulting from the use of the images or any defect in the images or manual even if they have been advised of the possibility of such damages. In particular, they shall have no liability for any programs or data used with SVP software products, including the cost of recovering or reproducing these programs or data. TRADEMARKS. Sanaa Village Publications and the Twinataa logo are trademarks of Williams Floyd and Moore. All other trademarked names used herein are the property of their respective owners. GENERAL. This agreement will be governed by the laws of the State of Tennessee except for that body of law dealing with conflicts of law.
